The following General Conditions (hereinafter "General Conditions") have been created to govern the use of the tourist services offered by Bikelife Active Holiday through the website www.isytravel.com and its application. Bikelife Active Holiday (hereinafter "Bikelife") is an online tour operator and travel agency, VAT number 02420460699, based in Francavilla al Mare (CH), C.da Castelvecchio 4, authorized by the Province of Chieti, General Protocol No. 11615 of 22.04.2016 and SUAP Protocol No. 15096 of 02/05/2016. Registration with the Chieti Chamber of Commerce No. 177967/2013. Bikelife Active Holiday is the owner and responsible for the content of the website www.isytravel.com.

Payment for the Price
To confirm the reservation, the traveler must pay a deposit of 30% of the total price of the package, or another amount indicated in the travel estimate, according to the accepted payment methods (credit card, debit card, SEPA transfer, PayPal, ScalaPay). This deposit includes the opening fee, taxes and legal fees, as well as the insurance premium for medical assistance and luggage, and, if selected during booking, coverage for trip cancellation. The traveler must pay the remaining balance of the package cost at least 40 days before the departure date by connecting to the Bikelife website (www.isytravel.com) using a credit card or other available payment methods.
If the reservation is made by the traveler within 30 days of the scheduled departure date, they are required to pay the full amount of the package, including all additional expenses, at the time of sending the reservation confirmation. In this case, it is the traveler’s responsibility to check with their consular authorities regarding the timing for the possible urgent issuance of a visa and/or any permits needed to enter the destination country. Bikelife cannot be held responsible for any customs issues the traveler may encounter upon arrival in the destination country.
Traveler Guarantees and Insurance
Bikelife, in compliance with industry regulations, is insured for the potential reimbursement of the price paid for the purchase of the travel package and the immediate return of the traveler in cases of insolvency and/or bankruptcy of the organizer. The entity providing the aforementioned guarantee is the Guarantee Fund with the insolvency and bankruptcy policy issued by NOBIS Insurance Company no. 6006002378/M, based on the provisions of Article 47 of Legislative Decree no. 79/2011 as amended by Article 1, paragraph 1, Legislative Decree of May 21, 2018, no. 62 2023/1-0247 membership document number. The traveler will be informed of the details of the guarantee, as well as the timing and methods for accessing it, at the time of signing the travel package contract.
Each package may include medical/luggage insurance, which can be purchased at the time of booking. In addition, after accepting the relevant terms and conditions, the traveler can purchase cancellation insurance as an optional service, always available with every travel package. Legal Sources and Applicable Law
Bikelife is responsible for the intermediation, organization, and sale of travel packages, with regular authorization according to national and regional regulations. In particular, the contract for the intermediation, organization, and sale of travel packages will be governed by these General Conditions, as well as by the applicable provisions of Legislative Decree of May 23, 2011, no. 79 (hereinafter referred to as the "Tourism Code"), as amended by Legislative Decree of May 21, 2018, no. 62 (which implements EU Directive 2015/2302), and any other provisions in force in our legal system applicable to the contracts covered by these conditions. Any disputes arising from or related to these conditions or the relationship between the user and Bikelife will be subject to the jurisdiction defined by Legislative Decree no. 205/2006 (hereinafter referred to as the "Consumer Code"), as well as applicable Italian laws. The contract between Bikelife and the traveler is considered concluded at the moment the General Conditions of Sale for Travel Packages are accepted.
Definitions
For the purposes of the intermediation and sale of travel packages, Bikelife, in accordance with Article 33 of the Tourism Code, specifies the following definitions:
- Professional: Any natural or legal person, public or private, who, in the context of their commercial, industrial, craft, or professional activities, acts in contracts covered by this chapter, also through another person acting in their name or on their behalf, as an organizer, seller, facilitator of related tourist services, or provider of tourist services, according to current regulations.
- Organizer: A professional who combines packages and sells or offers them for sale directly or through or together with another professional, or the professional who transmits traveler data to another professional.
- Seller: The professional other than the organizer who sells or offers for sale combined packages from an organizer.
- Traveler: Anyone who intends to conclude a contract, enters into a contract, or is authorized to travel based on a concluded contract, within the scope of this chapter.
- Durable support: Any tool that allows the traveler or professional to retain information personally addressed to them so that it can be accessed in the future for a period appropriate to the purposes for which it is intended and allows for identical reproduction of the stored information.
- Inevitable and extraordinary circumstances: A situation beyond the control of the party invoking such a situation, whose consequences could not have been avoided even by taking all reasonable measures.
- Lack of conformity: A failure of the tourist services included in a package.
Understanding Travel Package Concept
A travel package is defined as the combination of at least two different types of tourist services for the same trip or holiday, if at least one of the following conditions is met:
- These services are combined by a single professional, even at the request of the traveler or according to their selection, before a single contract for all services is concluded;
- These services, even if concluded with separate contracts with individual tourist service providers, are:
- Purchased at a single sales point and selected before the traveler agrees to payment;
- Offered, sold, or invoiced at a flat rate or global price;
- Advertised or sold under the name "package" or a similar designation;
- Combined after the conclusion of a contract allowing the professional to let the traveler choose from a selection of different types of tourist services, or purchased from distinct professionals through connected online booking processes where the traveler's name, payment details, and email address are transmitted by the professional with whom the first contract is concluded to one or more professionals, and the contract with the latter is concluded no later than 24 hours after the confirmation of the booking of the first tourist service.
Travel Package Terms and Conditions
Before concluding the travel package contract distributed or organized by Bikelife, it commits to providing the traveler, in a clear, precise, and readable format, in accordance with the provisions of the Tourism Code, the following information, specifying from the outset that the trips intermediated, organized, and/or sold by Bikelife are not suitable, by their nature and unless otherwise expressly indicated, for travelers with reduced mobility:
- The main characteristics of the tourist services, such as:
- The destination(s) of the trip, the itinerary, and the duration of stay with corresponding dates, including the number of nights if accommodation is included;
- The means, characteristics, and categories of transportation, the places, dates, and times of departure and return, the duration, and the location of any intermediate stops and connections; if the exact times are not yet established, the organizer, and if applicable, the seller, will inform the traveler of the approximate departure and return times;
- The location, main characteristics, and, where applicable, the tourist category of the accommodation according to the regulations of the destination country;
- The meals provided;
- The visits, excursions, or other services included in the total agreed price of the package;
- The tourist services provided to the traveler as a member of a group, including the approximate size of the group;
- The language in which the services are provided;
- The commercial name of the organizer, if this is a party other than Bikelife;
- The total price of the package including taxes and all fees, charges, and other additional costs, including any administrative and processing fees, or, if these cannot be reasonably calculated before the conclusion of the contract, an indication of the types of additional costs that the traveler may still incur;
- The payment methods, including the amount or percentage of the price to be paid as a deposit and the schedule for paying the balance, or the financial guarantees that the traveler is required to pay or provide;
- The minimum number of people required for the package and the deadline referred to in Article 41, paragraph 5, letter a), of the Tourism Code, before the start of the package for possible termination of the contract in case the number is not reached;
- General information regarding passport and visa conditions for entering the destination country;
- Information about the traveler’s right to transfer the package to third parties with reasonable notice and possibly upon payment of additional costs, as well as the right to withdraw from the contract at any time before the start of the package by paying appropriate withdrawal fees, or, if provided, the standard withdrawal fees required by the organizer pursuant to Article 41, paragraph 1, of the Tourism Code;
- Information on the optional or mandatory subscription to insurance covering the costs of unilateral withdrawal from the contract by the traveler or assistance costs, including return, in the event of injury, illness, or death;
- Information on the right to terminate the contract without incurring termination fees and to obtain a full refund of payments if any essential elements of the package, other than the price, have changed significantly; in any case, the organizer commits to providing suitable alternative solutions if some of the substantial elements of the package cannot be provided as agreed;
- Information on any increase in the package costs and the rights of the traveler, pursuant to the following Article 8 of these General Conditions;
- Details of the insurance coverage in case of bankruptcy or insolvency of the organizer.
Bookings
The travel package contract distributed, organized, and/or sold on Bikelife's website (www.isytravel.com) shall be considered concluded at the moment Bikelife receives the payment of the deposit and sends a confirmation of the contract via email, which can be downloaded on a durable medium. For the content of the travel package contract, please refer to Article 7 of these General Conditions.
Contract Terms and Conditions
Package travel contracts, pursuant to Article 36 of the Tourism Code, are formulated in simple and clear language and, where in written form, are legible. At the time of the conclusion of the package travel contract or, in any case, as soon as possible, the organizer or seller provides the traveler with a copy or confirmation of the contract on a durable medium.
Regarding contracts negotiated outside commercial premises, as defined in Article 45, paragraph 1, letter h) of the Consumer Code, a copy or confirmation of the package travel contract is provided to the traveler on paper or, if the traveler consents, on another durable medium.
The package travel contract and/or its confirmation contain the entire content of the agreement, including all the information referred to in Article 34, paragraph 1 of the Tourism Code, as well as the following:
- The specific requests of the traveler accepted by the organizer;
- A statement indicating that the specifically identified organizer is responsible for the proper execution of all travel services included in the contract pursuant to Article 42 of the Tourism Code, and is obliged to provide assistance if the traveler encounters difficulties under Article 45 of the Tourism Code;
- The name and contact details, including the geographical address, of the entity responsible for protection in the event of insolvency;
- The name, address, telephone number, email address, and, if available, fax number of the local representative of the organizer, a point of contact, or another service that allows the traveler to quickly and effectively communicate with the organizer to request assistance or to address any complaints related to compliance defects encountered during the execution of the package;
- The requirement for the traveler to report, without delay, any compliance defects detected during the execution of the package pursuant to Article 42, paragraph 2 of the Tourism Code;
- In the case of minors traveling under a package travel contract that includes accommodation and who are not accompanied by a parent or other authorized person, information that allows for direct contact with the minor or the responsible adult at their place of stay;
- Information regarding existing complaint handling procedures and alternative dispute resolution (ADR) mechanisms, pursuant to Legislative Decree No. 206 of September 6, 2005, and, if applicable, the ADR body to which the professional is subject, as well as the online dispute resolution platform pursuant to Regulation (EU) No. 524/2013;
- Information on the traveler's right to assign the contract to another traveler pursuant to Article 38 of the Tourism Code.
- Documentation regarding the medical and baggage assistance policy included in the package, as well as, if selected at the time of booking, documentation regarding coverage for trip cancellation.
Changes and Cancellations of Your Travel Package Before Departure
Price increases are possible exclusively as a result of changes concerning:
- The price of passenger transport based on the cost of fuel or other energy sources, where the service is expressly provided for in the contract;
- The level of taxes or fees on tourist services included in the contract imposed by third parties not directly involved in the execution of the package, including landing, disembarkation, and embarkation taxes at ports and airports;
- Relevant exchange rates for the package.
If the price increase referred to in this article exceeds 8 percent of the total package price, Article 40, paragraphs 2, 3, 4, and 5 of the Tourism Code applies. In particular, the traveler may accept the organizer's proposal for a substitute package of equivalent or higher quality than the original or exercise the right to withdraw without penalties.
A price increase, regardless of its amount, is only possible after clear and precise communication on a durable medium by the organizer to the traveler, along with the justification for the increase and the calculation methods, at least twenty days before the start of the package.
In the event of a price decrease, the organizer has the right to deduct actual administrative and management expenses from the refund due to the traveler, of which they must provide proof at the request of the traveler.
Before the start of the package, Bikelife reserves the right to unilaterally modify the terms of the contract, provided that the change is of minor importance, with notification given to the traveler in a clear and precise manner on a durable medium.
If, before the start of the package, Bikelife is forced to significantly change one or more main characteristics of the tourist services referred to in Article 34, paragraph 1, letter a) of the Tourism Code, or the essential characteristics of the tourist services, or cannot meet the specific requests referred to in Article 36, paragraph 5, letter a), or proposes to increase the package price by more than 8 percent, they must promptly notify the traveler in writing, indicating the impact of such changes on the package. The traveler may, within a reasonable period of five days, accept the proposed modification or withdraw from the contract without incurring withdrawal fees. In the event of withdrawal, which must be communicated in writing, Bikelife may offer, within the following five days, the traveler a substitute package of equivalent or higher quality.
Bikelife’s Liability for Incorrect Execution of the Travel Package
The organizer is responsible for the execution of the tourist services provided for in the package travel contract, regardless of whether such services are to be provided by the organizer itself, its assistants or appointees when acting in the course of their duties, third parties whose services are utilized, or other providers of tourist services, pursuant to Article 1228 of the Civil Code.
The traveler, pursuant to Articles 1175 and 1375 of the Civil Code, must inform the organizer, directly or through the seller, in a timely manner, considering the circumstances of the case, of any compliance defects detected during the execution of a tourist service provided for in the package travel contract.
If one of the tourist services is not performed according to the agreement in the package travel contract, the organizer must remedy the compliance defect, unless this is impossible or excessively burdensome, taking into account the extent of the defect and the value of the tourist services affected by the defect.
If the organizer does not remedy the compliance defect within a reasonable time frame set by the traveler, considering the duration and characteristics of the package, the traveler may personally remedy the defect and request reimbursement for the necessary, reasonable, and documented expenses; if the organizer refuses to remedy the defect or if immediate action is necessary, the traveler is not required to specify a deadline.
If a compliance defect, pursuant to Article 1455 of the Civil Code, constitutes a breach of significant importance regarding the tourist services included in a package and the organizer has not remedied it within a reasonable time established by the traveler, following timely notification, the traveler may, without incurring expenses, terminate the package travel contract with immediate effect or, if applicable, request, pursuant to Article 43 of the Tourism Code, a price reduction, without prejudice to any claim for damages.
In the event of contract termination, if the package included passenger transport, the organizer is also responsible for the return of the traveler using equivalent transport without unjustified delay and at no additional cost to the traveler.
Where it is impossible to ensure the return of the traveler, the organizer will cover the costs of necessary accommodation, where possible of equivalent category to that provided for in the contract, for a period not exceeding three nights per traveler or for a longer period as may be provided for by European Union regulations regarding passenger rights applicable to the relevant means of transport.
Traveler Responsibilities
Travelers are required to comply with the following obligations:
- Verify the accuracy of their personal data entered on the website at the time of booking; Bikelife is not responsible for any errors and/or inaccuracies in the travel documents, and the traveler must also check the accuracy of documents upon receipt and immediately report any discrepancies (e.g., mismatches with passport data).
- Comply with the health and prophylactic regulations of the destination country.
- Respect visa requirements and entry restrictions of the destination country, including those related to their nationality, obtaining relevant information from their embassy and/or consular authority; Bikelife is not responsible for any entry issues into the destination country.
- Hold a valid identity document for travel (identity card and/or passport) with a minimum validity of 6 months from entry into the destination country, unless otherwise specified by immigration regulations, which the traveler must verify with the consular authority of their country of residence and/or nationality.
- Consult the website of the Ministry of Foreign Affairs https://www.viaggiaresicuri.it/ to check the political/health situation of the destination country and any security-related aspects, including religious and social norms and customs.
- Verify the regulations regarding the travel of minors and the documents they must possess.
"MANDATORY COMMUNICATION PURSUANT TO ARTICLE 17 OF LAW N° 38/2006. 'Italian law punishes with imprisonment crimes related to prostitution and child pornography, even if committed abroad.'"
The trip organizer is not responsible for damages caused by the traveler due to non-compliance with these obligations, and the traveler will bear any costs for forced stays or early returns.
Limits of Compensation and Prescription Period
The compensation to which the traveler may be entitled is governed by Articles 43 and 46 of the Tourism Code, and in any case within the limits set by applicable international conventions related to the services included in the travel package. According to Article 46 of the Tourism Code, the right to compensation is subject to a three-year statute of limitations, or the longer period for personal injury compensation provided by the regulations governing the services included in the package, starting from the date of the traveler's return to the place of departure.
Deadline for Submitting Travel Complaints
The Traveler is required to promptly report to the organizer any non-fulfillment and/or inaccurate compliance encountered during the trip through a timely complaint to the local representative, so that the organizer, their local representative, or the escort can verify the tourist's claims and implement necessary measures. Furthermore, under penalty of forfeiture, the Traveler must send a complaint via registered mail with acknowledgment of receipt or via certified email within 10 days of their return.
Changes to Your Travel Package
Bikelife reserves the right to modify these General Conditions at any time to meet its operational needs or to comply with the latest regulations as necessary; such changes will take effect from the date of their publication on the Website.
Intellectual Property Rights
Bikelife is the owner of the website www.isytravel.com and all content and materials available on the site, including, but not limited to, logos, trademarks, distinctive signs, photographs, and texts. Any commercial use of such content is expressly prohibited. Product and company names mentioned on the site may be trademarks of their respective owners, and unauthorized use of these trademarks is also prohibited. Reproduction of the site's graphics and structure, in whole or in part, is forbidden; the constituent elements of the site may not be copied or imitated.
Right of Withdrawal Before the Start of the Travel Package
Pursuant to Article 41, paragraph 1 of the Tourism Code, the traveler can withdraw from the package travel contract at any time before the start of the package, with a refund to the organizer as specified below. The package travel contract may provide reasonable standard withdrawal fees, calculated based on the timing of the withdrawal, expected cost savings, and anticipated revenues from reallocating the tourist services. In the absence of specified standard withdrawal fees, the withdrawal fee corresponds to the package price minus the cost savings and revenues from reallocating the tourist services.
After receiving a formal cancellation request via PEC at claudiodidionisio@pec.webzone.it, Bikelife – even outside the scenarios expressly provided by law – commits to refunding the amount paid during booking, in accordance with the penalty percentages determined by the following criteria:
- More than 61 days before the departure date: 15% penalty of the total package
- 60 to 46 days before the departure date: 30% penalty of the total package
- 45 to 31 days before the departure date: 55% penalty of the total package
- 30 to 16 days before the departure date: 80% penalty of the total package
- 15 to 0 days before the departure date: 100% penalty of the total package
In case of unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity, such as – merely by way of example and not limited to – popular uprisings, exceptional and unpredictable natural phenomena that have a substantial impact on the execution of the package, the traveler has the right to withdraw from the contract before the start of the package without incurring withdrawal fees and to a full refund of payments made for the package, but is not entitled to additional compensation.
The organizer can withdraw from the package travel contract and offer the traveler a full refund of payments made for the package, but is not obliged to pay additional compensation if:
- The number of people enrolled in the package is below the minimum set by the contract, and the organizer communicates the withdrawal to the traveler within the deadline set in the contract, and in any case no later than twenty days before the start of the package for trips lasting more than six days, seven days before the start of the package for trips lasting between two and six days, and forty-eight hours before the start of the package for trips lasting less than two days.
- The organizer is unable to execute the contract due to unavoidable and extraordinary circumstances and informs the traveler of the withdrawal without unjustified delay before the start of the package. In the case of contracts negotiated outside commercial premises, the traveler has the right to withdraw from the package travel contract without providing any reason within five days from the conclusion of the contract or from the date they receive the contractual conditions and preliminary information (if later), without penalties if compatible with the penalties set forth in the first two paragraphs of Article 9 of these General Conditions and as provided for by the individual package. In cases of offers with significantly reduced rates compared to current offers, the right of withdrawal is excluded. In this latter case, the organizer documents the price variation, adequately highlighting the exclusion of the right of withdrawal.
